1. Acceptance of Terms

By accessing or using Hiye ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

2. Description of Service

Hiye is an AI-powered chat and roleplay application that allows users to:

  • Chat with AI characters powered by various AI models
  • Create custom AI characters
  • Explore community-created characters
  • Purchase virtual currency ("Gems") to power conversations

3. Account Registration

To use certain features of the App, you must create an account. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Promptly notify us of any unauthorized use of your account
  • Be responsible for all activities under your account

4. Age Requirements

You must be at least 13 years old (or the equivalent minimum age in your jurisdiction) to use Hiye. By using the App, you represent and warrant that you meet this age requirement. Users under 18 should have parental or guardian consent.

5. Virtual Currency (Gems)

5.1 Purchasing Gems

Gems can be purchased through in-app purchases via the Apple App Store. All purchases are processed by Apple and are subject to Apple's terms and conditions.

5.2 Using Gems

Gems are consumed when you send messages to AI characters. Different AI models may require different amounts of Gems per message.

5.3 No Refunds

All Gem purchases are final and non-refundable, except as required by applicable law or as otherwise stated in Apple's refund policies. Unused Gems have no cash value and cannot be exchanged for cash.

5.4 Gems Expiration

Gems do not expire as long as your account remains active. If your account is terminated, any remaining Gems will be forfeited.

6. User Conduct

You agree not to:

  • Use the App for any illegal or unauthorized purpose
  • Attempt to gain unauthorized access to the App or its systems
  • Interfere with or disrupt the App's functionality
  • Create characters that promote hate, violence, or illegal activities
  • Share content that infringes on others' intellectual property rights
  • Use the App to harass, abuse, or harm others
  • Attempt to circumvent any usage limitations or payment systems
  • Use automated systems or bots to interact with the App

7. User-Generated Content

7.1 Your Content

You retain ownership of characters and content you create. By creating public characters, you grant us a non-exclusive, worldwide, royalty-free license to display and distribute that content within the App.

7.2 Content Guidelines

All user-generated content must comply with our content guidelines. We reserve the right to remove any content that violates these Terms or is otherwise objectionable.

8. AI-Generated Content

AI responses are generated by third-party AI models and may not always be accurate, appropriate, or safe. You understand that:

  • AI responses are for entertainment purposes only
  • You should not rely on AI responses for medical, legal, financial, or other professional advice
  • AI may occasionally generate unexpected or inappropriate content
  • We are not responsible for the accuracy or appropriateness of AI-generated content

9. Intellectual Property

The App, including its design, features, and content (excluding user-generated content), is owned by TechParrot Innovations LLC and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our permission.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TECHPARROT INNOVATIONS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

12. Termination

We may terminate or suspend your account at any time for any reason, including violation of these Terms. Upon termination, your right to use the App will immediately cease, and any remaining Gems will be forfeited.

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes through the App or by email. Your continued use of the App after changes constitutes acceptance of the modified Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
